Terms of Service

By using the application of “Hapyson fishing measurement” (“APP”), which YAMADA ELECTRIC IND. CO., LTD. (“YAMADA”) provides the service, you are required to agree the terms of service (“TOS”). (We regard that TOS is automatically consented by you when you have downloaded APP.)

[ Service Conditions ]

1. You agree, without YAMADA’s permission,
(a) to not sell, rent, lease, re-grant, or transfer,
(b) to not modify or translate,
(c) to not reverse-engineer, reverse-compile, or disassemble
of part or the entire APP,
(d) to download, install, use, or duplicate APP for your personal use only.
2. YAMADA owns the copyrights and other full ownership rights for APP. The copyrights and full ownership rights will not be consent for transfer to you unless otherwise obviously stated.

[ Prohibitions ]

You agree
(a) to not infringe YAMADA’s all rights regarding APP,
(b) to not damage or do disadvantage to YAMADA,
(c) to not obstruct YAMADA’s operation for APP.

[ Limitation of Liability ]

1. YAMADA will not be liable in any way for any damage caused by your usage or unavailability of APP.
2. YAMADA shall not assume any obligation
(a) to modify APP according to your requests,
(b) to provide the upgraded APP,
(c) to save or delete your usage history,
(d) to provide support for APP.
Even if we provide the upgraded APP or our support at our discretion, TOS will be applied for such cases.
3. YAMADA shall not assume any obligation of modification and remedy for APP even if it should not be suitable for your machinery, equipment, or software.
4. YAMADA will hold no warranty on APP about accuracy, completeness, fitness for particular purpose, usefulness, legality and non-infringement to third party.

[ Modification of TOS ]

You agree that YAMADA has authority to modify TOS without your consent. We regard that you consent the modification of TOS when you use APP.

[ Application of law and jurisdiction ]

1. TOS shall be governed and interpreted based on Japanese law.
2. In the event of a judicial action about APP, it shall be resolved by the Osaka District Court as the agreed exclusive jurisdiction.
